Study of gambling services in the internal market of the European Union

This study provides a detailed analysis of the legal regimes governing gambling in the EU’s internal market. It also attempts to give indications on the economic development of the sector.

The study confirms that the gambling sector is subject to rules and regulations aimed at safeguarding public interest objectives in all EU countries. While pursuing broadly similar aims, the national laws and regulations vary considerably and frequently lead to barriers to the freedom to provide services and the freedom of establishment. These barriers are often incompatible with EU law.

Background

To obtain a detailed overview of the legal and economic aspects of gambling, the European Commission asked the Swiss Institute of Comparative Law to carry out a study into the sector. The study is the result of nearly two years’ work.
